In accordance with Ukrainian legislation every car owner is bound to have motor third party liability insurance aimed at settling financial claims of traffic accident parties which are associated with car repair. 

Below are the recommended steps to be taken in case of an accident. The most important thing is – do not panic and use one of the action plans offered below in order to make the claim process speedy and accurate.

Option # 1. Call the police (prev.-traffic police).

  1. If anyone injured – call the ambulance.
  2. Dial 102 to call the police.
  3. Make sure to have the police issue the following documents:
    - diagram of the traffic accident;
    - traffic accident report.
  4. Notify your insurer of the traffic accident first by phone written in your policy and in writing within the deadline stipulated by your insurance (normally – no later than 3 days from the moment of the accident). In addition to that the driver at fault for the accident is also to allow his car to be examined by your insurer.

The major flaw of this action plan is it being time consuming due to waiting for the police to arrive and draw up all the necessary papers.

Option # 2. European Accident Statement.

That is a simpler option since you don’t need to waste time waiting for the police. However it can be used only for the accidents meeting all of the criteria mentioned below:  

  1. Only two cars are involved in the road accident.
  2. No one is injured.
  3. No third party’s property is damaged. .
  4. Loss is under UAH 25,000.
  5. One of the parties in the accident fully admits his fault.
Insurance company is liable to pay the indemnity within 90 days from the moment all the required documents were submitted.
Only if all of the above conditions are met, your following steps might include:

  1. Do not call the police but fill in the European Accident Statement yourself. The form is usually provided along with your motor third-party liability insurance policy.
  2. Make sure to include the diagram of the traffic accident.
  3. Take some pictures of the accident site and damaged parts of the vehicles.
  4. Contact the call-center of your insurance company using the phone number provided in your insurance policy and submit the notification in writing no later than 3 days after the accident. Driver at fault must also provide his vehicle for inspection by your insurance company within the same deadline.

In both scenarios mentioned above an insurance company is liable to pay the indemnity within 90 days from the moment all the required documents were submitted.
